How tall a fence can be in Hamilton.
The rules below come from Fence By-law 10-142, as amended by 10-315 and 11-230, and cover Ancaster, Dundas, Waterdown, Stoney Creek, the Mountain and the lower city.

How it’s measured. From the finished ground next to the fence to its highest point. On a retaining wall, from the top of the wall.
Posts and caps. A decorative cap or a structural post may stand up to 0.15 m over the limit, a gate 0.3 m and an entrance arch 0.4 m.
Corners and driveways.
No more than 0.9 m inside a corner visibility triangle (5.4 m along each street) or a driveway visibility triangle (2.7 m along the driveway and the street), or within 3.0 m of the front lot line. The City asks owners of corner lots, and anyone fencing a front yard, to call before building.
Pool enclosures in Hamilton.
The pool enclosure needs a building permit, and nothing gets dug or built until it is issued. The pool stays empty until the enclosure passes inspection.
- At least 1.5 m (5 ft) high, measured from the ground outside the enclosure, which is higher than most towns ask.
- No openings wider than 100 mm.
- At least 1.0 m from the pool wall.
What needs a permit, and how to ask for more.
Permits. You don’t need a building permit for a fence unless you are installing a pool or replacing a pool enclosure.
Exemptions. The fence by-law has no exemption process. Call Municipal Law Enforcement before you build outside these limits.
- Neighbours split the cost of a 122 cm (4 ft) chain link fence on the line 50/50. Anything more is for the two of you to agree, and the City stays out of it.
Check with the city before you build.

This page covers heights, corners and driveways, pools and permits; the full by-law, linked below, covers everything else. We read each figure here from the city’s own documents and last checked them on September 26, 2026. By-laws change, and zoning, a subdivision agreement or a heritage designation can set a lower limit on your street. The city’s by-law office has the final word, so check with them before you build.
