Fence rules in Milton.
A backyard fence in Milton can be up to 2.0 m (6 ft 6 in). A pool needs an enclosure at least 1.2 m high, approved by the town before the water goes in.
How tall a fence can be in Milton.
The rules below come from Zoning By-law 016-2014 (urban area) and Zoning By-law 144-2003 (rural area), and cover Hawthorne Village, Willmott, Scott, Coates, Old Milton and the rural town.
| Where the fence is | Height limit |
|---|---|
| Back yard, side yard or side yard along a street | 2.0 m (6 ft 6 in) |
| Front yard | 1.0 m (3 ft 3 in) |
| Corner lot, where a front yard meets a neighbour’s back yard | 2.0 m on the shared line |
| Around a deck, up to 60% of its edge | 1.5 m above the deck |
| Next to a non-residential zone | 3.0 m (9 ft 10 in) |
How it’s measured. From the ground, not a built-up bank, to the highest point of each 3 m section. Where the ground falls away along the fence, a section may reach 2.3 m at its high point as long as its low point is 2.0 m or less.
Posts and caps. Decorative post caps and gate hardware don’t count.
Corners and driveways.
No fence at all inside a daylighting triangle at a corner.
Pool enclosures in Milton.
A pool or hot tub needs a pool enclosure permit, applied for online. The pool stays empty until the enclosure passes its final inspection, and the permit expires after six months. A temporary pool set up in the same spot each year needs no new permit.
- At least 1.2 m high and no taller than the zoning allows, at least 1.2 m from the pool edge, with no more than 100 mm of gap at the bottom.
- Boards go on the outside face. Gaps up to 38 mm where the rails are less than 1.2 m apart, up to 100 mm where they are further apart, and 38 mm on any section with a diagonal brace.
- No basket weave and no horizontal split rail.
- Gates close by themselves and latch at the top on the inside. A thumb latch doesn’t count.
What needs a permit, and how to ask for more.
Permits. An ordinary fence needs no permit. A pool or hot tub needs a pool enclosure permit.
Exemptions. Fence heights are zoning, so relief from them is a minor variance at the Committee of Adjustment.
- Many newer subdivisions have lower limits in their own zoning, often 1.2 m in a yard along a street. Look up your zone on the Town’s zoning map before you order.
- The Fence Apportionment By-law covers sharing the cost with a neighbour: talk first, then serve a Notice of Intent if you can’t agree.

This page covers heights, corners and driveways, pools and permits; the full by-law, linked below, covers everything else. We read each figure here from the town’s own documents and last checked them on September 26, 2026. By-laws change, and zoning, a subdivision agreement or a heritage designation can set a lower limit on your street. The town’s by-law office has the final word, so check with them before you build.
